Terms of Service

1. Services Offered

Lucid Foto provides professional, high-end executive headshot and portrait photography services in Austin, TX. By booking a session, you agree to these Terms of Service. Our services include the photography session, style consultation, and delivery of edited digital images as outlined in your selected package.

2. Booking and Payments

To secure your session, a 50% non-refundable retainer fee is required at the time of booking. The remaining balance must be paid in full prior to your session.

• All payments are processed securely. We do not store payment details.
• Prices are subject to change, but the price at the time of your booking is locked once your retainer is paid.
• Retainers are non-refundable as they reserve our studio time exclusively for you.

3. Rescheduling and Cancellations

We understand that schedules can change. If you need to reschedule your session:

• Rescheduling: You may reschedule once without penalty provided you give at least 72 hours written notice before your session time. Rescheduling with less than 72 hours notice may incur an additional fee.
• Cancellations: If you cancel your session outright, the retainer fee is forfeited.
• Late Arrivals: Please arrive on time. Your session time begins at the scheduled start time. Late arrivals will result in a shorter session. If you are more than 20 minutes late, the session may be considered a cancellation.

4. Image Delivery and Archiving

After your session, a proofing gallery will be provided for you to select your final images for retouching.

• Turnaround time for fully retouched images is typically 72 hours after you make your selections.
• Final images will be delivered via a private online gallery link.
• Galleries will remain active for 90 days from the date of delivery. It is your responsibility to download and securely back up your files during this period.
• We are not responsible for archiving or storing your images past the 90-day gallery window.

5. Copyright and Usage Rights

Client Usage: Upon final payment, you are granted a non-exclusive, perpetual personal and commercial use license for your delivered photos. You may use the images for LinkedIn, company websites, social media, press releases, speaking engagements, and personal branding. You may not sell the images to third-party stock photo agencies.

Studio Usage: Lucid Foto retains the original copyright to all images created. Unless a non-disclosure agreement (NDA) or privacy request is explicitly agreed upon in writing prior to the session, Lucid Foto may use select images for promotional purposes, including our portfolio, website, and social media channels.

6. Retouching and Editing

Our style emphasizes authentic, polished, and powerful portraits. Basic retouching (color correction, exposure adjustment, minor blemish removal) is included. Advanced retouching (e.g., extensive skin altering, body modification, changing clothing colors) is not our standard practice and may require a custom quote if requested. We do not provide unedited RAW files under any circumstances.

7. Liability

While we take every precaution to ensure the safety of your digital files and your physical safety in our studio, Lucid Foto is not liable for data loss due to equipment failure, nor for any injury, damage, or loss suffered during the session. In the unlikely event of total photographic failure or cancellation by Lucid Foto, liability is limited to a full refund of all payments received.

8. Client Conduct

We reserve the right to terminate a session immediately and without refund if a client exhibits inappropriate, disrespectful, or unsafe behavior toward our staff or equipment.
